1. Who these terms are with
These terms are an agreement between you and Poole's Pools Pty Ltd, ACN 700 605 241, ABN 20 700 605 241, trading as Poole's Pools ("Poole's Pools", "we", "us", "our").
"You" and "your" mean the person or organisation who books our services or for whom we supply them.
Where we supply services to a strata scheme, an owners corporation, a landlord or a managing agent, "you" means the party who books the services, and that party is responsible for payment whether or not it owns the property.
By booking our services or using our website, you agree to these terms.
2. Our services
We provide pool and spa cleaning, maintenance, water testing, repairs, and equipment supply and installation across Greater Sydney.
Services are subject to availability and scheduling. We will let you know as early as we can if a visit needs to move, for example because of weather or access.
3. Quotes
Quotes are valid for 14 days unless the quote says otherwise.
For quoted work over $1,000 including GST, we ask for a 50% deposit before we order parts or book the work. The balance is invoiced when the work is complete.
Chemical quantities in a quote are estimates. We charge for what is actually used.
4. Regular servicing and time on site
Each regular service includes up to 30 minutes on site for weekly services, 45 minutes for fortnightly services and 60 minutes for monthly services.
Any time beyond this is charged at $100 + GST per hour, billed in 15 minute intervals. For first-time cleans, we will always let you know before any extra time is charged.
Chemicals are billed in addition to all service packages. Parts are charged separately unless your agreement with us says otherwise.
All prices are per pool. A spa or second pool at the same property is priced separately.
5. Payment
Unless we have agreed different terms with you in writing, we invoice on completion of each service and payment is due within 7 days of the invoice date.
Payment is by bank transfer, using the details shown on your invoice.
Where we have a separate written agreement with you that sets out different payment terms, including commercial, strata and agency accounts billed monthly in arrears, those terms apply instead of this clause.
If an invoice is not paid by its due date, we may pause further services until it is paid.
6. Cancelling, rescheduling and changing your service
If you need to cancel or reschedule a booked service, please give us at least 24 hours' notice.
You can change how often we service your pool (weekly, fortnightly or monthly) with one visit's notice.
You can cancel an ongoing service with one month's written notice.
Please make sure we can get to the pool on the day, for example that gates are unlocked and pets are secured.
7. Access and safety
You agree to give us safe access to the pool and its equipment. If we cannot get safe access, we may need to reschedule the visit.
Pool safety barriers, fences and gates remain the owner's responsibility.
8. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.
Where the law allows us to limit our liability, our liability for a failure to meet a guarantee is limited to supplying the service again or paying the cost of having it supplied again.
We are not responsible for damage or loss caused by things outside our control, including existing faults in equipment, plumbing or the pool shell, weather events, or work done by others.
9. Website use
You may use our website for lawful purposes only. You may not copy, reproduce or distribute our content without our written consent.
10. Privacy
We handle your personal information in line with our Privacy Policy.
11. Changes to these terms
We may update these terms from time to time. The version on this page applies from the date it is published. If you have a separate written agreement with us, that agreement continues to apply.
12. Governing law
These terms are governed by the laws of New South Wales, Australia.
